This Payment Policy outlines the payment terms and conditions for all purchases made from Siemplex Distributors cc ("Company," "we," "our," "us"). By placing an order with us, you agree to the terms stated in this policy.

General Payment Terms

  • All prices are listed in Namibian Dollars (NAD) unless otherwise stated.
  • Payments must be made in full before any goods are processed for collection or handed over to a courier, unless a credit account has been pre-approved.
  • We accept the following payment methods:
    • Electronic Funds Transfer (EFT)
    • Bank Deposits
    • Debit and Credit Card Payments
    • Other approved payment methods communicated by Siemplex Distributors cc
  • No goods will be released without confirmation of cleared funds in our account.
  • We reserve the right to adjust prices at any time without prior notice, except for confirmed orders already paid in full.

Upfront Payment Requirement

  • All individuals and businesses must make full payment upfront before any orders are processed.
  • Orders will not be reserved or allocated until payment is received.
  • Any unpaid orders are subject to cancellation without notice if another customer completes payment first.

Credit Account Application

  • Any customer (individuals, small businesses, and corporations) may apply for a 30-day credit account with Siemplex Distributors cc.
  • No extended credit terms beyond 30 days will be offered.
  • Approval of a credit account is at Siemplex Distributors cc’s sole discretion and will be subject to a creditworthiness assessment, including:
    • Trade and bank references
    • Financial background checks
    • Business registration verification
  • Customers applying for a credit account must complete and sign a Credit Application Form, including acceptance of liability for all debts incurred.
  • Siemplex Distributors cc reserves the right to decline or revoke credit privileges at any time.

Credit Terms and Conditions 

    • Customers with an approved credit account must settle all invoices within 30 days from the invoice date.
    • If payment is not received by the due date, the following penalties apply:
      • A late payment fee of 5% per month on the overdue balance.
      • Suspension of future credit privileges until outstanding amounts are settled.
      • Possible legal action or involvement of a debt collection agency, with all associated costs payable by the debtor.
    • Credit accounts exceeding 60 days past due will be permanently revoked, and all outstanding balances will become immediately payable in full.
    • Customers must notify Siemplex Distributors cc in writing of any disputes regarding an invoice within 7 days of issuance. Failure to dispute within this timeframe will be deemed as acceptance of the invoice amount.

Payment Default and Collection 

    • Siemplex Distributors cc reserves the right to take the following actions in the event of non-payment:
      • Legal action to recover outstanding amounts, including interest and collection fees.
      • Personal liability enforcement for sole proprietors or directors of small companies (where applicable).
      • Repossession of goods, if legally permissible, for unpaid balances.
    • Customers will be liable for all legal costs, collection fees, and administrative charges incurred in recovering outstanding amounts.

Refunds and Cancellations 

  • Refunds will only be processed in accordance with our Refund and Return Policy.
  • Orders canceled before payment is received will not incur any penalties.
  • Orders canceled after payment is received but before shipment or collection may be subject to an administrative fee.
  • Orders that have been shipped, collected, or processed cannot be canceled and will be subject to our refund policy. 

Fraud Preventions and Verification 

  • Siemplex Distributors cc reserves the right to conduct verification checks for any payment received.
  • We may request proof of identity or additional documentation before processing an order.
  • Any suspected fraudulent transactions will be reported to the relevant authorities.

Force Majeure  

Siemplex Distributors cc shall not be held liable for any failure or delay in the performance of our obligations under these T&C caused by events beyond our control, including, but not limited to, natural disasters, government regulations, strikes, supply chain disruptions, or other unforeseen circumstances.

In such cases, affected payment obligations may be suspended until normal business operations resume.

Returned Payments and Chargebacks  

  • If a payment is returned or rejected due to insufficient funds, incorrect banking details, or any other reason, the customer shall be liable for:
    • A returned payment fee of NAD 250
    • Immediate settlement of the outstanding balance
    • Any additional banking or administrative charges incurred
  • Unauthorized chargebacks will be treated as non-payment, and the customer will be responsible for all associated legal and administrative costs.

Retention of Title  

  • All goods remain the property of Siemplex Distributors cc until full payment has been received and cleared.
  • If a customer fails to pay for goods within the agreed payment terms, Siemplex Distributors cc reserves the right to reclaim possession of the goods, subject to applicable legal procedures.

Currency and Exchange Rate Policy 

  • All transactions are conducted in Namibian Dollars (NAD).
  • Customers making payments in a foreign currency must ensure that the total amount received in our account matches the invoiced amount in NAD.
  • Any currency exchange fees or fluctuations in conversion rates are the sole responsibility of the customer.

Changes to Payment Policy 

We reserve the right to modify or update these terms at any time, without prior notice. Any changes will be posted on this page with an updated "Effective Date." By continuing to use the website after any changes to the Payment Policy, you agree to be bound by the updated terms.  

Dispute Resolution and Governing Law 

This Payment Policy shall be governed by and construed in accordance with the laws of Namibia. Any disputes arising under or in connection with this Payment Policy shall be resolved in the competent courts of Namibia.
